Business Loan Consultancy – Terms & Conditions

1. Introduction

This page outlines the terms and conditions for availing business loan consultancy services through CapitalBox. By engaging with us, the client acknowledges and agrees to the terms laid out herein, which are governed by the Indian Contract Act, 1872, RBI regulations, and relevant government policies.


2. Consultancy Fee

CapitalBox charges a one-time, non-refundable consultancy/processing fee of ₹1580 (Rupees One Thousand Five Hundred Eighty only) plus 18% GST, totaling ₹1864.40. This fee is strictly for professional services rendered to guide, prepare, and assist in the business loan application process. It does not in any way guarantee approval or disbursement of the loan.


3. Scope of Services

The processing fee covers the following:

  • Preliminary eligibility analysis of the client
  • KYC and financial document review
  • Guidance for application form filling
  • Mapping the client with suitable banks/NBFCs
  • Assisting in submitting the application
  • Follow-up and communication with lenders

No guarantee is made regarding loan amount, tenure, or approval, as all such decisions are at the sole discretion of the financial institution.


4. No Loan Guarantee

CapitalBox is a private consultancy firm, not a bank or NBFC. The client understands that loan approval is solely dependent on the lender, and may be influenced by the applicant's credit history, income, liabilities, documentation, and internal bank/NBFC policies. We do not offer any guarantee or assurance of approval or sanction.


5. Post-Disbursement Success Fee

Upon successful loan disbursement, the client agrees to pay a success fee ranging from 1% to 2% of the total sanctioned amount, depending on the complexity and amount of the deal. This fee:

  • Is charged only after loan disbursement
  • Is mandatory and separate from the initial consultancy fee
  • Is independent of any processing, insurance, or documentation fee charged by the bank/NBFC
  • Will be pre-agreed in writing before loan sanction

This is in accordance with standard consultancy norms under Section 73 of the Indian Contract Act, covering compensation for services rendered.


6. Refund Policy (Advance Fee)

If any advance portion of the success fee is collected and the loan is not sanctioned within 60 working days, the same shall be refunded in full, provided there is no delay or default from the client’s side. This includes failure to provide documents, incorrect information, or non-cooperation.


7. Client Responsibilities

The client agrees to:

  • Provide accurate and complete documents
  • Cooperate during verification, site visits, and calls
  • Respond to bank/NBFC requirements on time
  • Avoid submitting false or forged documents

Any fraudulent activity will result in immediate termination of services without refund and may be reported under the Information Technology Act, 2000 and Indian Penal Code (IPC) provisions.


8. Confidentiality

All documents, identity proofs, and financial records submitted by the client are treated as confidential and are shared only with authorized lending partners under mutual consent or regulatory obligation.


9. Bank/NBFC Charges Disclaimer

The client understands that any additional charges levied by the bank/NBFC—such as processing fee, insurance, legal charges, documentation cost, etc.—are not included in the ₹1580 consultancy fee and must be paid separately as per lender terms.


10. Legal Jurisdiction

Any legal dispute arising out of this engagement will fall under the jurisdiction of the Surat, Gujarat courts only. This agreement shall be governed by the laws of India.


11. Final Declaration

By proceeding with the payment and using our services, the client agrees that:

  • ₹1580 is only for documentation and consultancy assistance
  • Loan approval is not guaranteed
  • A 1% to 2% success fee is chargeable after disbursement
  • Bank’s own charges are separate and borne by the client
  • Any false claim may result in legal consequences
