1. Acceptance of Terms

By using any service provided by CapitalBox, you confirm that you accept these Terms and Conditions and agree to comply with them. If you do not agree, you must not use our services. These terms apply to all services offered through our website, WhatsApp, physical meetings, and phone consultations. Using our platform in any way implies consent. This agreement forms a legal relationship between the client and CapitalBox. It is advised to review these terms before availing services.

2. Nature of Services

CapitalBox provides consultancy services in the fields of Business Loans, Government Scheme Advisory, Legal Drafting, Advocate Lead Forwarding, and Documentation Support. We do not provide loans or legal representation directly. Instead, we guide, assist, and connect clients to appropriate solutions or professionals. All services are advisory in nature. We function as an intermediary in a professional capacity. Any misunderstanding about the role should be clarified before proceeding.

3. Client's Obligations

Clients must provide accurate, updated, and truthful information for all services. CapitalBox shall not be liable for any loss due to client-supplied misinformation or forged documents. It is the client's duty to cooperate during the entire process. Failure to provide correct documents may lead to delays or cancellations. We reserve the right to cancel services without refund in such cases. Client conduct must remain professional and respectful throughout.

4. Document Accuracy

The effectiveness of our service depends on the accuracy and completeness of documents provided by the client. Any forged, unclear, expired, or missing documents may halt or delay the service. CapitalBox does not hold liability for delays caused due to errors in documents. Clients are responsible for cross-checking all details before submission. We may request re-submission or clarification where needed. Verification is always mandatory.

5. Service Charges

All services offered by CapitalBox are paid and priced based on complexity, time, and resources required. Charges are communicated transparently before starting the service. Payments must be made in advance unless written agreements state otherwise. Additional charges may apply for urgent or revised requests. CapitalBox reserves the right to revise prices without prior notice. Government taxes such as GST are applicable as per Indian law.

6. Payment Methods

Payments can be made via UPI, bank transfer, or other authorized payment channels. Cash payments are accepted only at our registered office with a valid receipt. Payment confirmation must be retained by the client for records. Failure to pay may result in cancellation or withholding of the service. Refunds are processed only in accordance with the refund policy. Any issues in transaction must be reported immediately.

7. Refund Policy

No refund shall be entertained once service execution has begun. If CapitalBox is unable to initiate the service for any internal reason, a full refund shall be processed within 7 working days. Refunds will be made through the original payment mode only. Any false claims for refunds may result in legal action. Clients must provide transaction proof and service details to claim refunds. Refund decisions are at the sole discretion of CapitalBox.

8. Cancellation Policy

Clients may cancel a requested service before execution begins. Once work has started, cancellation is not permitted, and no refund will be provided. CapitalBox reserves the right to cancel any service if client behavior is inappropriate or information provided is false. In such cases, service fees will not be refunded. Mutual cancellation terms can be discussed only through written communication. Unresponsive clients are deemed to have voluntarily withdrawn.

9. Confidentiality Clause

All data and documents shared by clients will be kept confidential and used solely for service purposes. We do not share, sell, or misuse client information. Only authorized personnel or third parties involved in execution are granted limited access. Digital data is stored securely and protected through standard cybersecurity practices. In case of legal requirements, data may be disclosed to government or law enforcement agencies. We comply with applicable data protection laws.

10. Third-Party Involvement

CapitalBox may collaborate with third-party service providers such as banks, advocates, accountants, or loan agents to fulfill service requests. While we vet these parties, we do not guarantee their actions or timelines. Clients must directly communicate with referred parties for certain processes. Any malpractice by third parties must be reported to us. CapitalBox will not be held responsible for third-party negligence. Our role remains advisory and referral-based. 

11. Service Timeline

The duration required to complete any service depends on various factors such as document verification, client responsiveness, third-party processing, and government holidays. We do not promise any fixed delivery time unless explicitly stated in writing. Clients must cooperate timely to avoid delays. Estimated timelines are shared at the beginning for reference only. CapitalBox is not liable for unforeseen delays caused by external entities. Urgent processing may attract additional fees.

12. Verification Procedures

CapitalBox reserves the right to verify client identity, business credentials, and submitted documentation. This may include PAN, Aadhaar, bank statements, utility bills, or business registration proofs. Without successful verification, the service may be paused or canceled. Verification is conducted in accordance with RBI guidelines and Indian law. Any manipulation or fraudulent presentation will result in blacklisting of the client. We maintain a zero-tolerance policy toward document fraud.

13. Digital Communication Consent

By using our services, you consent to receive communication via email, SMS, WhatsApp, and phone calls. We may send service updates, document requests, confirmations, or promotional messages. You may opt out of promotional messages at any time. All communication records are logged for quality and legal purposes. Clients must ensure their contact details are correct and active. CapitalBox is not responsible for undelivered messages due to client error.

14. Use of Website or Platform

Use of the CapitalBox website, WhatsApp services, or any online platform must be lawful and non-abusive. Uploading malicious files, using bots, scraping data, or misrepresenting identity is strictly prohibited. Users found violating these terms may be blocked or reported to authorities. Any misuse of platform content for commercial gain or plagiarism is punishable under copyright laws. Access to the platform may be restricted without notice if misuse is detected.

15. Legal Drafting Services

Our legal drafting services include preparation of agreements, notices, affidavits, and other legal formats based on the client's needs. We are not a law firm and do not provide courtroom representation. Documents are drafted based on standard formats and client input. It is the client’s duty to review the draft before final use. For complex legal disputes, we may refer you to licensed advocates. We hold no liability in case of legal misinterpretation.

16. Advocate Lead Forwarding

CapitalBox connects clients to independent advocates for matters such as FIRs, bails, notices, and court cases. We only facilitate the connection and do not control or interfere in the legal advice or fees charged by advocates. All dealings after referral are solely between the client and the advocate. Clients must conduct their due diligence before proceeding. Any dispute must be resolved directly with the advocate. Our role ends at referral level.

17. Loan Consultancy Process

CapitalBox provides consultation for business loans through banks, NBFCs, and government channels. We guide clients on documentation, eligibility, and bank coordination. We do not guarantee loan approval, as decisions depend on bank discretion and creditworthiness. Clients must disclose all existing liabilities honestly. Misuse of consultation for fraudulent purposes will result in legal action. Loan-related service fees are non-refundable once processing begins.

18. Government Scheme Advisory

Clients seeking assistance under various government schemes (PMEGP, Mudra, MSME, etc.) are responsible for checking eligibility. We assist in documentation, portal application, and handholding support. Government processing time and decisions are beyond our control. We do not charge for government benefits, only for consultancy. CapitalBox will not be responsible if the application is rejected due to client-side errors or incomplete data. Transparency is maintained at every step.

19. Limitation of Liability

Under no circumstances shall CapitalBox be held liable for indirect, incidental, or consequential damages, including loss of income or opportunity. Our maximum liability, if any, is limited to the amount paid by the client for the concerned service. We shall not be responsible for failures due to technical errors, government delays, or third-party negligence. Clients agree to use our services at their own discretion and risk.

20. Dispute Resolution

In the event of any dispute arising between the client and CapitalBox, both parties shall first attempt to resolve the issue amicably through written communication. If unresolved, the matter shall be subject to arbitration under Indian Arbitration & Conciliation Act. Venue for arbitration shall be Surat, Gujarat. The language of arbitration shall be English. Legal proceedings, if necessary, shall be under the jurisdiction of Surat Civil Courts only. 

21. Force Majeure Clause

CapitalBox shall not be liable for any failure or delay in service performance due to unforeseen events beyond our control, such as natural calamities, strikes, internet outages, cyber-attacks, government lockdowns, or riots. These events will be treated as force majeure. In such cases, services may be paused or rescheduled. No refund or penalty shall be imposed under such conditions. Clients are requested to cooperate in such exceptional situations.

22. Non-Guarantee Policy

CapitalBox provides support and consultancy, but we do not guarantee approvals, sanctions, or outcomes related to bank loans, legal matters, or government schemes. Final decisions rest solely with respective authorities, banks, or courts. We ensure proper process guidance but cannot influence official results. Clients are advised not to assume success solely based on consultancy. Service charges apply for efforts, not for outcomes.

23. Behavioral Code of Conduct

Clients are expected to maintain respectful and professional behavior toward all CapitalBox team members. Use of abusive language, threats, or misbehavior via call, message, or in-person will lead to immediate termination of services without refund. We maintain a respectful work environment and reserve the right to block abusive clients. Lawful action may be initiated in extreme cases of harassment.

24. Amendments and Updates

CapitalBox may update or revise these Terms & Conditions from time to time without prior notice. Clients are encouraged to review the terms regularly. Continued use of our services after such changes will be deemed as acceptance of the revised terms. Major policy changes will be highlighted on our website or via official communication channels. Archived versions of previous terms may be made available on request.

25. Digital Signature and E-Agreements

All service consents, agreements, or approvals can be executed through digital means including WhatsApp confirmation, email approval, or via recognized digital signature platforms like Odoo. These shall carry full legal validity as per the Indian IT Act and are enforceable in legal proceedings. Clients are advised to keep their approval records safely for reference. No physical signature is necessary unless demanded by law.

26. Intellectual Property Rights

All content, formats, templates, and written material provided by CapitalBox — including website content, drafts, reports, or advisory material — remain the intellectual property of CapitalBox. Clients may not copy, redistribute, or commercially reuse our materials without written permission. Violation of IP rights may result in civil and criminal liability. We reserve all rights to protect our proprietary work.

27. Fraud Prevention Measures

CapitalBox follows strict fraud monitoring and client verification practices. Clients using fake documents, false identity, or pretending to be a business for unauthorized gains will be blacklisted. Such acts will be reported to banks, law enforcement, and relevant platforms. No support will be extended to fraudulent applicants. All records of such activities are stored and can be legally used.

28. No Partnership or Employment

Using CapitalBox services does not create any partnership, agency, joint venture, or employment relationship. We operate as an independent consultancy firm. Clients and third-party vendors are not considered as agents or employees. Any representation made by such persons without our consent will not be recognized. Legal claims cannot be made on the basis of such assumptions.

29. Service Completion Certificate

On successful completion of the service, a digital service completion report or certificate may be issued upon request. This acts as a record for both parties and confirms that CapitalBox has fulfilled its consultancy obligations. The certificate does not guarantee outcomes or approvals, only process completion. Clients must retain such confirmation as proof of delivery, especially for audit or accounting purposes.

30. Governing Law and Jurisdiction

These Terms & Conditions are governed by and interpreted in accordance with the laws of India. Any disputes or legal issues arising shall fall under the exclusive jurisdiction of the courts located in Surat, Gujarat. Clients hereby agree to submit to the legal system of India for any conflict resolution. The applicable laws include Indian Contract Act, IT Act, Consumer Protection Act, and related regulations.

31. KYC & Compliance Clause

CapitalBox follows Know Your Customer (KYC) norms as per government and financial regulations. Clients must provide valid ID and address proofs before availing financial consultancy. KYC is essential for onboarding and document processing. Failure to complete KYC will result in suspension of services. We report any suspicious transactions or behavior to relevant authorities as part of our compliance obligations.

32. Client Acknowledgement Clause

By initiating any service request, the client acknowledges that they understand the scope, limitations, and professional boundaries of CapitalBox services. They accept that they are dealing with a consultancy platform and not a loan provider, law firm, or government body. Misunderstanding or incorrect expectations will not qualify for refunds. Acknowledgement is implied through continued usage or written approvals.

33. Language of Communication

CapitalBox primarily operates in English, Hindi, and Gujarati. Documents, communications, and explanations will be offered in any of these languages upon request. If the client requires documents in a specific format or language for legal or personal reasons, this must be mentioned at the beginning. Miscommunication due to language misunderstanding must be clarified early during the service period.

34. Customer Support Availability

Customer support is available Monday to Saturday from 10:00 AM to 6:30 PM (IST) through WhatsApp, email, or call. Responses outside business hours may be delayed. Emergency communication must be marked accordingly. Support requests are addressed in the order received. Clients are advised to maintain politeness during support interaction. Multiple follow-ups in short span may delay the process.

35. Service Delivery Channels

All services shall be delivered through one or more of the following channels: Email, WhatsApp, Google Drive, Physical Meetings, or Secure Upload Portals. Clients must regularly check their preferred channel for updates. We are not responsible for delays caused due to client’s failure to check communication. Secure file sharing is always encouraged to protect sensitive data.

36. Misuse & Blacklisting Policy

Clients who misuse CapitalBox’s name, logo, brand identity, or refer our name falsely for unauthorized influence in any external organization will be permanently blacklisted. Legal notice may also be issued for brand misuse. A blacklist entry means future services will be denied across all CapitalBox platforms. We maintain the right to report such actions to partner networks and legal forums.

37. Consent for Recording

Phone calls, WhatsApp chats, or video meetings with CapitalBox may be recorded for training, legal, or quality purposes. By engaging with our platform, the client provides implicit consent to such recording. These records are stored securely and not disclosed unless required by law. Clients who object must notify us before interaction begins, otherwise consent is assumed.

38. No Legal Validity of Verbal Promises

Only written communication via email or official WhatsApp is considered valid for commitments, offers, timelines, or approvals. Verbal promises by any staff without documentation will not be enforceable. Clients are advised to insist on written confirmation for clarity. This protects both parties from misunderstanding and ensures professional transparency in service delivery.

39. Client Feedback and Reviews

CapitalBox may request client feedback, testimonials, or reviews after completion of services. While this is voluntary, your honest input helps us improve. If you agree, your review may be shared on our website or social media (without disclosing personal details). Negative feedback should first be raised directly with our team for resolution before being posted publicly.

40. Acceptance Checkbox or Signature

To access or purchase any paid service from CapitalBox, clients must check the “I Agree” box (online) or sign a consent form (offline) indicating acceptance of these Terms & Conditions. This is a mandatory compliance step and serves as proof of informed agreement. Without this step, no service shall be activated or considered valid under legal compliance. 

41. Multi-Platform Identity Protection

CapitalBox operates only through officially declared platforms and verified contact channels. Any person or group using our name, logo, or brand on unauthorized pages or profiles is considered fraudulent. Clients must verify communication sources before making any transaction. We are not liable for any fraud committed through unofficial platforms. Report impersonators immediately for legal action.

42. Client Responsibility for Follow-up

While CapitalBox tracks all service progress internally, the client is equally responsible for responding to document requests, status updates, or follow-up messages. If the client remains unresponsive for more than 7 days without prior notice, the service may be marked inactive or closed. Reactivation will require written approval and may attract additional charges.

43. Retention of Records

CapitalBox retains digital copies of service-related documents, communications, and drafts for a maximum period of 6 months from service completion. After this, data may be permanently deleted for storage and privacy compliance. Clients are advised to download and store their documents securely after final delivery. Retrieval of old files beyond this retention period is not guaranteed.

44. Sub-Consultants or Delegation Rights

To ensure timely service delivery, CapitalBox reserves the right to delegate work to trusted sub-consultants, freelancers, or partner agencies. All such delegation will be within professional and confidential limits. The client is not permitted to bypass CapitalBox and directly engage our back-end partners during or after service. Any such violation may result in legal notice.

45. Prohibited Content Policy

Clients must not submit, share, or request creation of content that promotes hate speech, communal violence, religious bias, obscenity, or political propaganda. We reserve the right to reject such requests without refund. CapitalBox supports ethical and legal communication only. Any misuse of services for unlawful documentation or influence will be reported.

46. Communication Escalation Matrix

Clients who are dissatisfied with service or communication may escalate the matter in a structured manner. Step 1: Raise complaint with assigned executive. Step 2: Email the team lead at support@capitalbox.in. Step 3: Request a final call from management. Each complaint will be acknowledged within 48 working hours. We aim for fair and timely resolutions.

47. Temporary Suspension Clause

CapitalBox may temporarily suspend services due to internal system upgrades, public holidays, staff training, or urgent audits. Clients will be informed in advance wherever possible. During this time, service progress may pause, and queries may be addressed slower than usual. No refunds are applicable during temporary suspensions unless work was not started at all.

48. Non-Disparagement Clause

Clients agree not to publicly defame, troll, or publish negative/unverified statements about CapitalBox or its team on social media or public platforms without first attempting direct resolution. Doing so may result in legal defamation notice. We are open to feedback and encourage proper channels for complaint resolution before going public.

49. Affiliate/Referral Earnings Disclaimer

If clients are offered referral incentives or affiliate rewards, such benefits are subject to verification and may take 30–60 days for release. CapitalBox reserves the right to deny incentives if false referrals or manipulated claims are detected. All affiliate earnings are subject to GST compliance and may require PAN card submission before release.

50. Comprehensive Legal Binding Clause

These Terms & Conditions form a legally binding agreement under the Indian Contract Act, 1872. By proceeding with any service, clients confirm that they understand and accept all clauses. In case any clause is found invalid by court, the remaining clauses will continue to remain in force. This document supersedes all prior oral or informal arrangements. 

Client Declaration & Acceptance

I, the undersigned client, hereby declare that I have read and fully understood the complete set of 50 Terms & Conditions of CapitalBox’s Loan Consultancy Services. I acknowledge that I am entering into this consultancy engagement voluntarily, with full knowledge of the scope, limitations, and responsibilities outlined.

By signing this declaration, I confirm the following:

  • I understand that CapitalBox is a consultancy firm, not a bank, lender, or financial guarantor.

  • I accept that approval, rejection, or delay of any loan application is at the sole discretion of the respective bank, NBFC, or financial partner.

  • I confirm that all information and documents submitted by me are genuine and correct to the best of my knowledge.

  • I agree to the consultancy fee, refund policy, and understand that no verbal or informal commitments override these written terms.

  • I accept that CapitalBox’s role ends after submission or forwarding of my loan file unless otherwise agreed in writing.

This declaration is made with clear understanding, and I undertake not to hold CapitalBox or its team liable for any outcome outside the agreed consultancy scope. I agree to abide by all the terms provided and confirm that this signed document serves as my full consent.
